I think this kind of illustrates that a criminal justice system is manned by flawed people in all aspects- flawed prosecutors, flawed defense attorneys, flawed judges, flawed defendants. To lionize any of them is a mistake, because humans are inherently flawed. And the judge's authority is undercut when he exposes his own misunderstandings of the case and its implications. Its not like he's some partisan here- its the same judge that ordered the 302 released like the Republicans demanded- but the fact he was spouting off about 'treason' was absurd. I'm sure it makes for good spectacle, but it cheapens the trust in the system. Can we trust that the prosecutors and judge have all carefully weighed and considered appropriate the prosecution of Flynn when regards are given to the intrusion of the judiciary and FBI onto both the executive's prerogative over foreign policy and the candidate's affairs of his own campaign? Everything from the 302 reaffirms the dangers of the FBI poking their heads into international affairs and micromanaging diplomatic relations. Even if those interventions could be done with impartial precision, it would imperil executive authority. But when you have a cloud of politicization, FBI agents clearly infected with bias and political animus, and a judge with the care of a bull in a china shop- we can't trust the system. Let alone the damage it does to interdepartmental cooperation when white house officials and other IC leadership can no longer trust their casual contact with the FBI and need lawyers present to defuse any traps.
- 99% of people criticizing this judge or law enforcement are doing so because they are partisan hacks.. after this investigation is over they'll go back to not caring about what happens in our justice system every day
- the judge wanted the 302 released not because Republicans demanded it, but because he wanted to fully understand what nonsense Flynn's lawyers were spouting in the memo
- the executive's prerogative over foreign policy was intruded upon by the transition team, which the judge noted
- it's the FBI's job to suss out foreign influence on our politics
- the 302 makes clear that Flynn understood what the FBI was coming over for, but he chose to lie multiple times anyway
I think this investigation shows that the system was and is working... FBI and DOJ officials were doing their jobs while a corrupt campaign and transition team were moving in. I said this before... the Hannity spin might matter in opinion polls, but judges aren't buying it.
