Leaving is based upon your attack speed (next attack). Just like moving positions, etc. That's why you can't leave when paralyzed.
Note that in the future, disconnecting will not instantly remove you either, just like many other persistent online games do a similar thing.
If you log into the game from another tab will it kick the initial instance out like it has previously?

This is not different than before. In the old days HC players would have 2 tabs open of LS. One to play on and the second had your username/password already put in just incase lag caused you to need a fast disconnect you could log in on the other tab and it would disconnect the original instance and possibly save the character.
