I think the item is really cool and rare, but like others pointed out, Grief would be better, and at a lower lvl req :(
When upping items, the level requirement will be:
max{old_rlvl, new_base_item_rlvl, socketable_rlvl} + Penalty.
normal->exceptional, Penalty= 5
exceptional->elite, Penalty= 7
double upped, Penalty= 12
