Yes it is. Fg can be aquired with real money. And The simple answer to this post is. Yes it is against tos to trade things for fg. You can ofc use this site to trade item vs item since that isnt forbidden.

yes, but in my example the person selling the item for FG to another person, is not acquiring the FG through real money. that doesn't fit "exchange of payment"

but the seller who acquired the FG sold an item for that FG, he never exchanged $ for it. i do agree with your other point, but in my case, i believe it doesn't violate (blizz doesn't care about that nuance, they just have a blanket view of if jsp = bad)

Well. In one way i dont blame them. This site was created to bot the living hell out of d2. I would have a pretty bad view on a site like that if i had a gaming company. And in your example i think you are even breaking 2 different games tos. Since people seem to be soo scared in poe that people talk about jsp

jsp is treated like all the other sites you can buy items/resources for money, even tho fg can be obtained by selling other items you can still buy fg for real cash so blizzard don't care = you get banned.

FG is not RMT.

It is not 'illegal'. It is against the TOS. You cannot argue against it no matter how unfair you think it is because it's a game not an essential service and companies are given wide leeway to moderate their players. Unless your country passes laws that directly overturn the TOS you have no leg to stand on.
