Failing to render aid does not make it murder, causing the death does. You can get criminally negligent homicide from failing to render aid when you have a responsibility to do so for someone in your custody, but that is manslaughter, not murder.
They need to establish beyond a reasonable doubt that he caused the death, which is precisely what's missing from this criminal complaint without a medical examiner's report.
Oh, darn. I put a <B> tag in the wrong place. Silly me. Keeping your knee on someone's neck for 10 minutes falls under the category of "perpetrating an act eminently dangerous to others". And considering you had people screaming to help him, Floyd himself saying he couldn't breathe, and another officer playing guard dog for him, it's not a stretch to argue that there was a disregard for human life, especially after Floyd became unresponsive and calls to "check his pulse" were clearly made.
