Open borders is implicit in the inaction or refusal to enforce penalties.
Honestly this is really simple. Tougher punishment for X usually leads to less of X happening. Having no punishment for X and expecting X to magically stop or desist is pie in the sky.
You don't want a wall, you don't want people detained that break the law by crossing illegally, so what is your grand plan to fix the borders?
