Newsom's Waterloo

On October 1, Newsom announced his student vaccine mandate. A press release oozing with self-satisfaction declared California the “first state in the nation."

Two months later, we remain the only state. New York, Michigan, Illinois, and every other state – red or blue – has rejected his mandate. Newsom thought he'd be a hero. He’s now looking to save face.

Families are leaving public education in droves; school boards are passing resolutions of opposition by the dozen; parents are banding together and fighting back. Many Californians who accepted previous mandates are seeing with fresh eyes what’s been going on all along.

There's a sense this is Newsom’s Waterloo: the moment where his corruption and publicity-seeking have caught up with him, where his disregard for personal freedom and the rule of law have finally gone too far.

Newsom is also maintaining his school mask mandate despite new scientific findings on the harm to kids. Incredibly, some districts are still requiring masks outdoors. At a hearing this week, I asked the San Diego Superintendent for evidence to justify this policy. He couldn’t provide any.

We now know the virus will be “endemic." What remains to be seen is whether the collapse of our form of government will be as well. This is the time to fight.

The Ultimate Lawsuit

Gavin Newsom is off to NYC to promote his new children’s book. This comes after 3 days in Nevada, a week in Cabo, and a mysterious 13-day disappearance.

He’s chosen a bad time to go jet-setting. Just as courts have stopped all 3 of Biden’s mandate orders, the Orange County Board of Education, led by Mari Barke, has filed a lawsuit to terminate the State of Emergency.

The premise is simple: a Governor doesn’t get to end the emergency at his leisure. He’s required to do so “at the earliest possible date that conditions warrant.” The Court made this clear in my case against Newsom:

“The Emergency Services Act is not a statute of indefinite duration…The Emergency Services Act obligates the governor to declare the state of emergency terminated as soon as conditions warrant.”

In Gallagher and Kiley v. Newsom, the Court based its decision on the need for a Governor to respond quickly to emergency conditions. This suggests that if the Governor vacates his office to go on a book tour, it’s no longer legally an emergency.

This is the ultimate lawsuit, as ending the emergency terminates all other orders automatically. Granted, the courts have failed us time and again. But with Newsom barely ever in California, they'll have a harder time ignoring what a farce this has become.

Groundhog's Year

In many ways 2021 has felt like a repeat of 2020. But unlike Bill Murray’s iconic character, who improved as he lived Groundhog’s Day over and over, Gavin Newsom has learned absolutely nothing.

Case in point: yesterday he reimposed a statewide mask mandate, despite data showing that counties with mandates have fared no better than counties without them.

That's what I discussed this Sunday on Fox News. California has been the most coercive state in every way – business shutdowns, school shutdowns, church shutdowns; mask mandates, vaccine mandates, vaccine passports – and gotten nothing in return.

Newsom latest edict, of course, is an exercise of "emergency powers." Recently, he was asked when the emergency will end. He responded "we’ll know it when we experience it.” Our Governor just vacationed in Cabo and went on a book tour; I think we’ve experienced it.

Meanwhile, we've just learned California is illegally paying six figures to a “Superintendent of Equity” who lives and works as a life coach in Philadelphia. He happened to be in the wedding of our state schools chief who hired him.

I’ve reported this to the Governmental Operations Agency, which is reviewing my letter. It’s a reminder that even before the insanity of Newsom’s one-man rule, our Capitol was already a place of madness.
