The appellate court has already been asked to provide a writ of mandamus to force Sullivan to dismiss the case. To say that Sullivan has final say is incorrect. He has 10 days to explain himself to a higher Court.

Sullivan has likely overstepped. He is at odds with both the precedent of the DC Appeals Court and the Supreme Court. It is the judge's role to adjudicate, not second guess the prosecution, usurp the executive's authority to press and drop charges, or introduce a new amici process into the proceedings.
