There would need to be a compelling interest to do, which there is not. Although, depending on the venue there may be a line for one restroom and not for another. Lots of people have used the men's/women's room because there's otherwise no-one in there or they simply just need to go.

Well no, it is the desire for change that needs compelling interest (or the identification that there is a lack of compelling interest when challenging the status quo). Who is challenging the current bathroom setup in your specific example. You may pivot to transgender folks, but your original question is framed about everyday men and women. Nobody seems to be challenging that in any level of earnest worth considering.
