No evidence from UN Russia is using cluster munition in Ukraine. The explanation for delivery is very easy: they are running out of other shell types.
The impact is negative one way or the other. Cluster munition is going to be used on Ukrainian territory => future generation of Ukrainian children are going to be killed/maimed by remnants/duds.

It is widely reported, accepted, from western media, that russia uses cluster munitions. can you fact check your statement that russia is not using them?

ergo, the US is now sponsoring war crimes, potentially, whatever that means.

They aren't sponsoring war crimes because they distinguish that based on how the munitions are used. The use of them is not considered a war crime in itself by the US, only the indiscriminate use of them against civilians, which of course is determined by western based or funded organizations.

Also US cluster munitions supposedly have a lower dud rate than Russian versions so they are seen as more "civilian friendly" because they leave behind less unexploded munitions.

And realistically, the petal mines spread all around Ukraine right now are probably a much bigger risk for civilians, and nobody really cares about those

Petal mines are even worse.

Petal mines are russian, few petal mines may have been used by Ukrainian military and it is investigated by Ukrainian authorities.

In much highter quantities russians used these Russia-made "petal" mines.
