The Endless Emergency

Gavin Newsom has just issued an Executive Order predicated on the State of Emergency continuing to March 31, 2022. This is completely lawless.

It’s what James Gallagher and I warned the courts about in hundreds of pages of briefing. Newsom will never give up power voluntarily – even, it turns out, during a mysterious 13-day disappearance.

The Governor did resurface on Monday. He explained he was out for Halloween, though some have raised questions as to when trick-or-treating became a two-week event, how that squares with photos of him at the Getty Wedding, and why his whereabouts were a tightly guarded state secret.

All the while, California’s COVID “case rate” (the key metric according Newsom) is now twice Florida’s. We still have the nation’s worst unemployment. We still have a school mask mandate rejected by even New York City's new mayor.

And I continue to get reports of cruelty at some schools, like lunchtime in the rain. I’ve issued a request, joined by Senator Scott Wilk and Reopen CA Schools Founder Jonathan Zachreson, for an oversight hearing into these inhumane conditions.

The good news: A Recall of SF school board members has such momentum even the liberal mayor and state senator now support it. The parent revolution has begun.

The Simplest Legislation

School boards across California are passing resolutions opposing Newsom’s student vaccine mandate. Yesterday, I supported a similar resolution passed by the El Dorado County Board of Supervisors.

We remain the only state with this radical mandate, yet Newsom refuses to lift it. Worse, he says he’ll continue the State of Emergency as long as COVID is around. In other words, he plans to permanently abolish constitutional government.

As Dan Walters writes, Newsom intends to "govern by decree" indefinitely, "further eroding the American concept of checks and balances.” That's why the Legislature must act. When we reconvene, I’m insisting a vote be held on ACR 46, the simplest legislation I've ever authored:

"The Legislature, in accordance with Section 8629 of the Government Code, declares that the state of emergency proclaimed by Governor Gavin Newsom on March 4, 2020, is at an end and that the emergency powers granted to the Governor as a result of that proclamation are terminated."

From the beginning, Newsom saw COVID as an “opportunity for a new progressive era.” He’s used that “opportunity” to inflict on us the nation’s worst and most regressive outcomes. But we’re fighting back like never before – for our kids, for our Constitution, for our state’s future.
