Murder is a crime with five elements: Actus reas, mens reas, causation, harm and concurrence.

If their actions were not the cause of his death, did not act outside the police guidelines, did not intend any harm nor inflicted any, than its clearly not murder.

We are going to disagree on this and neither will budge.
