Sure. Some people simply trespassed or engaged in destruction of property. Just because they were part of a group engaged in insurrection doesn't mean they'll be subject to a charge of the insurrection statutes. That's kind of obvious, right?

An insurrection can happen without guns. And the hesitancy of small groups of police officers to engage a huge crowd of people (mostly) without firearms shows why your argument makes no sense. It also shows how the Capitol police were incredibly restrained, and I'm glad they were. In all of the violence on that day, only one officer shot an insurrectionist, and it's because she climbed through a broken window(in a passageway they barricaded) which led to members of Congress.

But there were insurrectionists on Capitol grounds with guns. That's been established in court filings.
