if you tamper with an investigation you can only be guilty of tampering if you're found guilty in the investigation? Like what? Obstruction is a crime, not an aggravating factor for sentencing....

That is actually part of the legal wording of obstruction. Doing otherwise would be a costitutional crisis which is likely to still happen

the part the Trumpsters seem to be focusing on is they think if Trump wasn't charged formally than he couldn't be guilty of obstruction. Which is not true.
