unless i misunderstand the situation, defendants have the right to a mistrial if they can prove evidence the prosecution had that would have proven them innocent was withheld.
i dont believe that works in reverse, they cant say "well this proved me guilty, and was entered into the case".
evidence can be entered after initial discovery as a result of cross examination of witnesses, although it must be relevant and legally obtained. which this seems to be.
