So you want to ban animal experimentation? I can get onboard with it.

Give this paper a read my friend: https://www.ncbi.nlm.nih.gov/pmc/articles/PMC2561859/

Gives a good outline of the topic at hand.

This paper also highlights the use of anesthesia. As long as anesthesia is issued during a particularly painful experiment, there is no cruelty.

so you agree that prisoners should have to consent to these experiments? no consent = no experimentation ?

I personally do not agree that they should have to consent, but it would be a good logical step in the right direction to first only allow experimentation on the consenting. Then it would depend on if enough of them do consent.

I feel like the justice system can already abuse the punishments it currently doles out, which are already nasty enough with solitary confinement, forced labour, etc.

As long as a punishment is not cruel or unusual by common law, of which legitimate scientific experimentation is neither cruel nor unusual as it is directly purpose driven, it should be fair game

It certainly can and it does, but I feel like the abuses we see in the current prison system would be dwarfed by the sort of things that would take place if it became acceptable to experiment with prisoners.

Why can't something purpose driven be cruel and unusual? I think maybe I misunderstood something

if there is no consent, theres nothing that separates forced medical experimentation from that of the Nazi's. the article you linked me says exactly the same. consent would have to be mandatory

But I don't think we need to obtain consent for punishment. For example, we don't ask death row inmates whether they consent to being executed. We just execute them.

cruel and unusual punishment ("experimentation" in this case) explicitly violates the 8th amendment. personally, Im against the death penalty and it has been argued before the Supreme Court that it is/was cruel and unusual in Furman vs Georgia

“Even though it was quite short-lived in suspending the death penalty in the U.S., it completely changed its course because it essentially inspired or required states to rethink how they were doing capital punishment. And ultimately, the practice of the death penalty changed substantially over time.”

execution is only a legal form of punishment in 27/50 states and a lot of those states dont even execute people anymore, its withering away as a form of punishment
