Based on the definitions I think most appropriate and likely is 3rd degree murder.
500fg on 3rd degree murder. Your everything else.
If a mistrial is decided on appeal or at any time during the remaining trial, we will defer to the results of the second trial, and if they don't bring the charges again after a mistrial after some reasonable amount of time, I lose since that would be effectively an acquital.

TBH, aren't both possible? Can't he be convicted, and subsequently win a mistrial ruling and get a new trial?

TBH i'm not 100% sure on that process. but if it ends with a mistrial then i would win

new trial would mean a new bet

That seems really counterintuitive doesn't it? But based on a plain reading, I feel like the manslaughter charge is inappropriate whereas 3rd degree murder is appropriate.
