Depends how its done. If its a tax on guns that goes specifically to the cost of gun related crime, that might be narrowly tailored for a specific problem like we discussed earlier.

Is earmarked taxation even allowed in the U.S.? And if so, it it also allowed on the municipal level?


Here in Germany, one of the fundamental principles of our tax code is that no tax can be earmarked for a specific purpose. Afaik, that's the case in most continental European countries. *shrug*

Yes, highly criticized for it's waste but it's definitely allowed.

Are you referring to earmarked spending, or do you really mean earmarked taxation, i.e. taxes which raise money that goes into a separate fund and can only be spent for a specific purpose?

Property taxes go to schools, gas taxes go to roads. Earmarked taxation is absolutely a thing in the states.

Huh, interesting. I stand corrected then.

It's still obvious that this ordinance will immediately trigger fierce court battles.

Probably would, and it would be up to the federal judges if this was specific and narrowly tailored enough to pass muster.

gun rights groups will take this up to the supreme court, where it gets smacked down.

Maybe, maybe not. It's not dead in the water at least, there is at least some level of argument to be made. I'd say with the current make up of the court it's more likely than not that it would get overturned, but I have been surprised before.
