So anyway we're 116 pages in but I think its a good time to refresh on what the premise of all the state vs federal hooplah is about. How can it be that Minnesota is not a sanctuary state, complies with ice detainers at prisons, is as far north as north gets, and still has a seemingly unlimited number of criminal illegal aliens known to authorities on databases that they can spend millions of manhours hunting down? Well just look at how previous federal attorneys cleaned up crime in Minnesota. Andrew Luger singlehandedly caused a 20%+ murder drop when he imprisoned a whole bunch of known gang members. By simply prosecuting them on federal charges for crimes the state had already convicted them on.... and imposed no penalty. All these illegal aliens are in the same boat, they can commit crimes freely in Minnesota and rack up charges and never go to prison so they never get handed over to ICE, and eventually police stop responding to crime scenes and citizens stop calling police and the crime reporting rate goes down.
EX Javier Alexander Ramirez Llumiquinga 35 was just picked up by ICE. He had 2 prior DUI convictions and 2 or more pending DUI charges and driving without a license, spun out on zero bail in each charge and no prison time when convicted. The prisons might honor ICE detainers, the courts don't, and refused to hold him despite having his active detainer request. After all, MN courts would argue- they have no right to legally hold someone for ICE, they would say its unconstitutional to jail him for a federal request. While they let him skate with zero bail on numerous crimes.
Thao Pao Xiong, 41 was picked up by ICE and he had convictions and charges for 5x felony auto theft, 7x identity theft, regular theft, drugs, terrorist threats, possession of burglary tools, domestic abuse. Had active ICE detainer orders presented to MN courts for years. Was never held. After all, Minnesota never gave him any prison time for his serial crimes, so the prisons never turned him over to ICE and the courts and jails don't hold people for ICE so he remained in the country until ICE went and got him in Metro Surge.
Countless examples like this. MN won't enforce its own laws, and created this insane decriminalization effort where we still charge and convict people- most often in absentia as they skip their court dates- and then give them no penalties. Courts and jails won't honor ICE requests and say they have no legal basis to hold someone, and it takes murdering someone to get into prison and even then Mary Moriarty might give you a pass
