We still don't know which gun was fired first here, and it could well be the officer gunned him down with no true provocation, it could be the p320 misfired and made the officers think he was shooting them
Either way the NYT is clearly in the wrong and posting misinformation

The p320 does not accidentally discharge. That was bullshit from airmen that killed their friend. I carry a p320 m18. I’m 7k rounds through it now and haven’t had an accidental discharge yet. Then again I understand firearms and received actual training in a prior career. I completely understand how an ICE dipshit under Trump would accidentally discharge a firearm. They’re you guys cosplaying as real law enforcement.

The military cleared the p320. It’s back in service. Stop blaming an accidental discharge on anything other than ICE incompetence.

The FBI couldn't even get it to improperly discharge through repeated testing. I’m calling baby back bullshit. I’ve been following this since the first news story hit about accidental discharge and each story turns out to be complete bullshit.

He showed the process and made it repeatable. As long as the trigger is even slightly depressed, less than a millimeter- including manufacturing defect or foreign detritus or just external forces- jostling the slide can strike a live round. Even through the safety on.
And that was just repeatable conditions, not the full potential of accounting for p320 uncommanded discharges
Which makes it absolutely a possible explanation for this story, pending further evidence of which gun was fired and when
