Replacing law school students doing clerking with hallucinating AI has some funny impacts. Clark v Bowcutt 2018 in the 10th circuit said pretty much exactly the opposite, in circumstances mirroring this one. Kirby v Duva had them shooting at a stopped vehicle that they had not perceived as an imminent threat

to be clear here, i think the officer has legal immunity and the case will be settled that way. out of court civilly, not criminally. then again, chauvin happened.

but from my viewpoint its more of a garner v TN case, she's a fleeing felon. his fear of life claim to me is bogus, even though i know caselaw will likely disagree. he got barely nudged so he's in the clear legally. he's still a trigger happy idiot who never should have been in the front of that car. bad training, worse trigger discipline.

All of this doesn't change the fact that legally he was justified in using deadly force.

Tires started to spin, accelerator pressed, all while tires were facing straight ahead before turning them. He pulled the gun out right away and used deadly force which is pretty standard when someone drives at law enforcement. Vehicle is a weapon.

All of that but but but excuses for her are irrelevant. She stomped on the gas while a federal agent was standing in front of her vehicle. Fucked around and found out.

Could you explain how you feel he was justified to use deadly force?

"Law enforcement may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or another person"

A stoped vehicle hitting someone feet away at that slow of speed is in no way shape or form putting that officer in imminent danger.

I've been hit by a vehicle traveling faster than that and had minor cuts and scrapes

Ok, she’s a criminal? Charged, Tried, and Conviction for some past offense? From what I’ve seen and read, she was just in the wrong place at the wrong time — a FAFO moment at most. Calling her a ‘dangerous criminal’ seems completely unfounded.

if we are speaking basic's I would say she was in the wrong place at the wrong time, she had a FAFO moment and the ICE response was disproportionate to the act. I think I need to leave this topic before I get mad, or worse, drive other people mad.

when i say criminal, i mean in the act of a crime. i dont think she has a record that ive seen.

your last 2 sentences are just about 100% accurate id say.

Huge difference of state vs feds. The state paid millions to the family of the cold blooded murderer who got killed whole fleeing officer Kim Potter. But this womans family could sue the feds all day long and not get any obama bucks. Maybe Minnesota will invent some cock and bull reason to pay her despite having nothing to do with it, lord knows that would be right up Walz's alley

You can see the vehicle was lined up with the officer, the tires are straight, she threw it and drive and hit the gas and her tires spun out on ice. That moment was when he reacted and chose to use deadly force and justifiably so, the near miss or minor collision and her turn were all split second outcomes that we can't expect people to anticipate. The same icy road that had disabled the vehicle they were trying to extricate probably also saved this guys life when her lack of traction stopped her from lurching 20 ft forwards into him. And besides the case law making it abundantly clear officers have no obligation to avoid putting themselves in front of vehicles or use least intrusive force (Bowcutt), its also just basic human decency and road safety and "not being a murderer". I mean shit are we supposed to gun it and mow down anyone who jaywalks in front of us at intersections while stopped? She was blatantly ignoring the safety of bystanders and pedestrians. She had no idea if anyone was behind or to the sides of her, she didnt stop and check blind spots, she was surrounded by people and chimping out

Renee Nicole Good, 37, lived in Minneapolis with her partner just blocks from where she was shot... She was not the masked invaders that came to her neighborhood ...She was not a radical ..people assuming she some crazed driver... masked police are more ruthless ..The mask gives them more authority to do war crimes...it a fact...

Blocking Federal agents with your vehicle is not radical?

More to the point, she was a member of an organized radical group. They showed up precisely to obstruct federal law enforcement.

this part is just false. the moment an officer walks in front of a vehicle he needs to be planning on what he'll do if she stops, reverses, or goes forward. he's not there to just be a braindead traffic cone. he clearly wasnt thinking, because his first reaction wasnt self preservation but a panicked draw of his firearm. in the same time it took to draw, aim, and fire, he could have sidestepped even a straight traveling vehicle. he didn't, his first reaction was dead force. if she was facing straight he'd have killed himself, because her dead body would have run him down. this is common in officer cross examination, "what were you thinking leading up to x, y, and z". not just "what was in your head in this 1 second we see". he's still likely legally covered, just bad training and worse execution.

I wouldn't be surprised if this officer was trained to do exactly this in this type of scenario.

Is it punishable by death? (If we ignore “assault with a deadly weapon” situation).

They should have all been arrested with severe community service sentences.

I wouldnt either. but tbh the "ICE IS UNDER ATTACK" narratives are so strong in the media im sure most agents are also scared as hell and expecting to die any time they're in the open.
