Jack Smith's testimony basically boiled down to him saying that the first amendment doesn't give Americans the right to express views critical of the government, and we could lock people up just for accusing the government of malfeasance.
We stripped away all the nonsense about conspiracy or incitement or overt acts and the entire election case was distilled into its central argument: The Biden administration claimed all it takes to lock someone up is them expressing the view that the election was rigged.

If the government can claim you are engaged in 'illegal false statements' for doing nothing more than stating your personal opinion that a government function has been corrupted, then that's a total revocation of the first amendment.
