Probably due to legality issues and Paul not wanting to invite trouble.

EDIT: Cease and desist letters has been sent to every single private server that was ever established, so that Blizzard can prove they have taken steps to protect their intellectual property if they ever want to take it to court. The same cannot be said for private projects for Diablo 2. If Blizzard choses they can sue anyone hosting a private server for copyright infringement and they could do the same against d2jsp by association. Same can not be said about Diablo 2 since they have not protected it in a timely manner so it would not hold up in court.

Biggest misconception in protecting an IP, you don't have to immediately go after them or "lose the ability" to pursue action later, I'm really curious where this misconception stemmed from because a lot of people love to parrot it around recently.

The more aggressively your protect your intellectual property the stronger your case stands in court. I am not saying your have to act immediately but in American court it's more about building a case than being right or wrong.
There is not a single private World of Warcraft server which has not been hit with a cease and desist warning. The same cannot be said for private Diablo II servers or projects.

The only reason they haven't been hit is there is no profit to really be made in d2.
Wow is a whole other beast, it is their highest earning game by MILES, and it's not even close.

If they wanted to shut down pd2 they could, easily, but it's financially not worth it, since pd2 does not really take any profit from blizzard.

League of legends sued L# like... 3-4 years later with no C&D ever being sent, and successfully won, granted it wasn't ONLY for making cheats, which do infringe on the IP.

So you agree with my initial comment and answer to the question of the topic creator?
That the reason we cannot trade on private server for World of Warcraft on d2jsp is because Blizzard actually gives a shit with these and Paul doesn't want to invite legal trouble by association?

no, as you state they couldn't pursue d2jsp because they haven't done so in a "timely manner" which is bullshit.
I agree with you saying wow sent every server a c&d, but NOT to protect their "ip in a timely manner", reason jsp doesn't allow pservers is simply to not get more eyes here than wanted.

d2 mods require you purchase a copy from blizzard. Wow pservers do not, simple as that.

One is stealing customers from blizzard while the other is making them sales.

This just further supports what I am saying?
That d2jsp doesn't allow trading on pservers because Blizzard seems to care about those, as seen by the cease and desist notes, which you are no also saying.
However they do allow trading on pservers in Diablo II because Blizzard hasn't shown to care about those.
I never said anything about pursuing d2jsp in a timely manner I was talking about the private servers.
You seem to disagree with me and then draw the exact same conclusions as me followed by the same arguments as me.

Yeah good point that certainly has something to do with it as well.
