Well they should.

Besides, I don' have a problem with smoking because it doesn't kill sentient beings except those who are doing the smoking.

same reason liquor isn't illegal. people will continue no matter the law just based on their own wants.

Liquor doesn't kill people as long as the one who's drinking is repsonsible, e.g. not drunk and driving.

responsible drinking is contradictory since drinking makes you act irresponsible. drunk driving while the most dangerous is not the only way liquor can kill you since it destroys your liver. plus abusing alcohol easy since its easy to get and easy to get drunk. smoking and liquor are still legal while weed is not for one reason..alcohol and cigs are chosen by adults while pot is chosen by kids and immature people for the most part.
