Here he is just playing on words, the state of no points is thought to be a valid state, so there is no need for this.

Why not. The creation of the universe, from nothing, violates no known laws, and is consistent with observation. Doesn't mean it happened that way, but it may have.

you could also have included what inflation explains, i think it something about the uniformity of the background radiation or something?
