I know right, if that was genuinely the case and he opened a ticket with his friend coming forward to confirm and they look at his account and it's clean i'd like to think they'd unban in that case, however they are very strict about removing bans because if they do it for one, they must do it for everyone and the flood gates open.

9 times out of 10 if not more, those crying about getting banned because their "friend" sent them gold bought the gold from certain other sites but no one's going to admit that of course.
Was it within the first 3 months or so of launch? I think there was either no bans or the criteria was absurdly high to get your account flagged. That's how people have a full set of level 10 gems and aren't banned because they did it before the big crackdown on bots and RMT. Personally i think it was a business decision not to ban players in the beginning for RMT, or maybe they were getting a cut who knows, but now they're hemorrhaging players and they have their addicts and long term players on lock that are shovelling money from their bank accounts to the in-game store so to keep them happy they're banning the RMTers now.
You're right about people claiming they don't RMT though and using 'my friend sent it to me' as an excuse when they get caught so the person i saw on forums may well fall in to that category.
