It's such an intrecate system that it's bound to have an occasional fault. (at least that's what I'd say if I worked for Treyarch)
Fact is, Theatre has just an abundance of flaws, and if you even slightly take clip gathering as serious business, you should invest into a PVR.
... and to answer your original question: I don't believe so, you just have to accept what it decides gives you.
