Basically the DEA and FDA make the rules concerning the classification, unless congress and president steps in to force the change. The DEA in particular takes great interest in keeping as many things illegal as possible because its what pays for their fat agency. The DEA isnt going to budge on the issue unless they are forced to by the FDA or new federal law. The FDA, while corrupt in their own ways, are probably less at fault here. The FDA takes a LONG time to approve substances for medicines or food additives, sometimes decades. While there is a heap of research out there, the FDA likes to do their own contracted research which takes ages.
As for the CARERS act. Its still floating around the senate but hasn't been voted on because Senator Chuck Grassley (current chair of the Senate Judiciary Committee) will not give it a hearing for votes. You can read more about the stalled bill here:
