Our mom bought this game and is allowing my brother to play it, that is apart of her judgment and the game cannot sue my family UNLESS it states that those that violate are subject to prosecution.

She was indicted for "one count of conspiracy and three counts of accessing protected computers without authorization to get information used to inflict emotional distress on the girl." This case is completely irrelevant to your half-ass attempt at an argument. Learn to uses your sources for an argument, just like my brother has used in me. The girl that killed herself in this case was also underage. Did you notice that? Is her family being charged with anything? No. There is no law to breaking the terms of service, unless otherwise stated.
Now with your bar comparison. I laugh at you. Your parents CAN give consent to drink at a bar dumb ass, but they have to be with you. As a 20 year old I have drank with my mom at bars for the last 3 years.
