A: They must admit to selling them as duped
B: They are not selling them to somebody at a price that ruins the economy if they follow (A)
C: The JSP economy is held up by these, in a way, because with out them there'd be no guide to how much certain other items are worth (such as similar rare items, the "perm" version of the items, etc)

There's a difference between selling unperm as perm and selling unperm as unperm.

No one has a problem w/ selling unperm as unperm because:

a ) It lowers the price of the item considerably. In USWest sc nl, a perfect unperm anni costs 50 fg, as does a perf coa. These are temporary because, chances are, they will poof later on. Buyers know this, and only use these items until they get the legit version.

B ) Jewels, runes, sojs, etc. are often immediately socketed, used for crafting, sold for dclone to spawn, etc. Because of their immediate use, no one is going to complain. If 40/15's weren't duped, a single jewel would most likely cost several hundreds, if not thousands, of fg. While I avoid duped items all together when I can (I'll use a crappy anni over a perfect, but unperm, anni anyday), let's be reasonable. Once a jewel is in an armor, it's there forever unless destroyed by hel + tp scoll.

However, unperm as perm sellers are considered scammers on this site. I've seen several of them locked after a large group of various sellers reported their "legit" items poofing. If the seller isn't locked, and people still post saying they are unperm as perm sellers, they quickly find themselves in a hole because no one wants to do business with them.
