They don't have to be level 1, all characters expire after X time, if I'm not mistaken every 60 days. Then they spend some time in 'Expired' status (10-15 days) and afterwards end up being deleted from the account.

Expired Status:
Your character list may read "Expired".
If you log in before someone else takes your exact character name, the character is fully restored and the timer resets.
If the name is taken, the character is deleted

the question is wether or not the character is instantly deleted or just overwritten but remaining on the account after the name is taken ( i know it cant be recovered still )
that is the big question i need answered.

The Char is still in the acc with expired tag on it but still refreshable
if the name will be taken by other player it will be gone forever tho

They are deleted directly. You could check it by trying to create a character with the same name, it will let you create it without any problem.

Ah i was confused by your pms. you said it disappeared.
i assumed it vanished from the account.

Yes, now the characters are really fully deleted from the account few days after expiration. You don't need your name to be taken anymore to loose your character. You will just see a blank space instead
