yet i've just had a discussion with a dude - who asked Spetch if its really an illegal trade to sell d2 charnames.

Iirc your allowed to sell names in the diablo II section as long as the seller deletes the name and the buyer creates it...

- Your not allowed to sell the name(s) with/on the account.
- Your not allowed to "move" said name with a 3rd party program.
- Your not allowed to sign into another users account to create said name as this violates bnet tou via account sharing...

The rule is correct.

so its just about the way the names are transfered?
but issnt it much more unsafe to just trust the person to delete it? i mean there is no guarantee that no1 else might create the name before the "buyer" does.
seller might tell his friends to spam create, he deletes, and one of his friends is faster than the buyer.
is that really the way to "sell names"?

i bet none of the d2 name trades have gone that way. all names come with account

Yes, that does happen. In some cases refunds are given if the name is lost during the transfer, in other cases refunds are not offered. It's best to discuss with the seller the terms before hand.

1) You arrange a time to meet in game/channel.
2) The seller back outs and counts to 5-10 and deletes the name/char.
3) The buyer then creates the name/char within that 5-10 second window.

I've sold a few names myself with no issues.

If your offering to sell names with/on account your topic will be closed as selling accounts is not allowed any more.

all it says its illegal to trade names. but if u trade in "correct" way its not illegal

Basically, you can trade a name if all your going to do is delete it so that the other person can create it.
No account sharing involved.
