seller might tell his friends to spam create, he deletes, and one of his friends is faster than the buyer.

Yes, that does happen. In some cases refunds are given if the name is lost during the transfer, in other cases refunds are not offered. It's best to discuss with the seller the terms before hand.
1) You arrange a time to meet in game/channel.
2) The seller back outs and counts to 5-10 and deletes the name/char.
3) The buyer then creates the name/char within that 5-10 second window.
I've sold a few names myself with no issues.
If your offering to sell names with/on account your topic will be closed as selling accounts is not allowed any more.
