To your question the behavior is prohibited within certain parameters. It doesn't say you can't use these things, you can't advertise them or talk about their usage.

They're not selling their programs or whatever or suggesting you do what they do. This would be a huge no no and in this case because of the type of services they're providing they have to add how its done. The act isn't the problem.
