time restriction wise? or do i actually have to wait the 24hrs.

Changing the time on your DS menu should do it. It might be based on the internal clock of Emerald though.

changing the ds time makes it say "you are using a different Nintendo Ds, or its internal clock has been altered. If the game's time setting is changed, you will not be able to migrate Pokemon for antoher 24 hours."
