Actually the very reason you said is the very reason they don't have good n64 games on the virt console(besides mario/zelda/starfox-which is their own exclusives, so duh).
But on a n64, it doesn't matter if they own rights to it anymore.
Like I can go to my local pawn shop and pick up games fairly easy.
