Further, they collect all "User Content," which they define as all "[...] comments, messages, images, photos, movies, information, data and other content" (Chapter 6, Nintendo 3DS End User License Agreement).

There is. You just have to not enter your personal info on every single page that requests it.

So everyone else is fine with Nintendo claiming the right to record ALL data going out of your 3DS, including photos, audio, all text you put in and everything you do in any game or application running on the 3DS? They even claim the rights to publish your photos to the public if they feel like it. I've seen stuff like this before, just not this this bad.
