Upon further research there is a code involved but I dont think anybody ever see's it but whomever is the giftee.

Yeah, check out that site it's dumb how Xbox does it even because you dont have to put a code in anywhere. Just check your message and redeem it.

I see what you mean. Theoretically it should be allowed but I'm 99% sure they won't allow it just because

Considering its Xbox themselves that sends the code upon puchase. Im sure this would be a legal trade. It isnt like the scarch codes where you have to get it from an irl store.
IIRC the rules were in place for Exclusive codes/Live codes/gamepass codes/cash codes. The ones off cards are guaranteed illegal trades.

I dont see an issue with Xboxs digital gift feature, i agree that alot more research needs to go into this as the feature has only been around since late 2018.
1. The game sender never sees the redeem code
2. Xbox sends the redeem code and button the the one receiving the game
