No such rule exists.

Just like when someone accidentally puts their good items in the market for 1 fg (or some other ridiculously low amount) and someone else snipes it from the market.

It may be considered “bad manners” but it is not illegal here.

Illegal Trades:
Do not steal other people's trade threads. (you may be warned for this, as it is spamming).
No trades via PM. (It's harder to prove a scam via PM than from a trade thread, so always negotiate and deal through a trade thread, not PM).
Do not trade for / sell real life items outside the Donor Forum. This includes but is not limited to CD keys. No linking to any outside auction or trade sites.
Do not trade accounts, characters, or names. (Exceptions: Eve Online, Diablo 2: Names are allowed)
Be specific in your trades. List everything that is for sale, especially in packages, with as much detail as possible. Unlimited quantity sales are not allowed.
Do not offer fg/items you don't have.
Do not trade items cross games/realms/cores.
Do not use false advertising to describe an item. For example, if an item is a common dupe and is being sold in mass, it cannot be described as legit/perm/whatever else you may use to imply the same meaning.
Do not advertise items not directly for sale via d2jsp. This includes advertising an item that is on an auction house within a specific game.

There is or was a rule that all trades are done via the trade post and NOT PM'ing people.

This is my understanding of trades even from D2 days and their items, to me, this also implies trading LS items.

EDIT: just read the rules posted earlier during my time posting my point, and yup, it is illegal to trade via PM's.

Maybe we can get an answer on why it is so commonly overlooked, and from what little I may know, never punished for?

So long as the item has been posted in a thread, any further communication via pm is acceptable from my understanding.

Edit: to add though, it's always been the responsibility of each individual trader to keep their own records, screenshots, etc.

True, but as a rule of thumb I use, I get them to post their offer in the trade thread beforehand... or (OR) if I agree in the PM, I will quote it and post it in MY trade thread so that others know not to post more.

This way, everyone sees' what transpired in the trade thread.
