Those are called unspawns now.
In previous versions of the game, stats weren’t bound by tier caps and tier 1s could drop with like tier 12 stats.
That was patched long ago and now only overspawns exist.
Items can drop with stats one tier above its allotted maximum

Unspawns still exist in the game, but can no longer drop.
Only overspawns can drop now.
