The sun's gravitational draw on the Earth isn't strong enough to overcome Earth's gravitational draw on the water.

There is no force from the solar system acting on the Earths atmosphere other than vacuum, which can't overcome gravity any more than a suction pump can lift a column of water more than roughly 23 feet. Basic physics stuff here.

But why debate the point anymore? You've conceded to gravity.
