He still scammed; that's like a thief robbing a bank and when he gets caught saying, "oh we don't need a court case, I'll just give you guys the money back and it's all cool."

Then he just goes out and steals again, and gets away with it the next time.

ye well considering how its illeagal to share accounts, it would be more like "thief getting caught by stealing from murderer"

Alright well I'll admit that's a little steep of an analogy, but it still applies.

You can say shoplifter then if you really want to, and they steal less then enough to make it a felony. They still get probation and have to pay fines.
