Doesnt the copyright only count when you use the picture commercially?

No, although that's a common misconception.

I thought the rule with the tower was that you can't publish pictures of it that are taken at night due to copyrighting from the people that did the lightning for it.
But you can take a picture of some one standing in front of the tower during the day...as long as the shot is of the person with the tower as a background.

Still stupid.

That's what I said. Also, it's not just restricted to publishing.
