Hey guys have a problem im stuck on, fairly easy.. im in college this is my laws on contracts class
have to write a few page paper on this problem..Parole evidence Rule - Carlin owned a dairy farm that was aprpraised at 125,000$ in 2007.
in 2009 carlin told donald he intended to sell the farm for 100,000$.
donald offered to buy it. carlin agreed to sell it provided he could live on the farm for the remainder of his lfe.
A purchase and sales agreement was execited which stated carlin will transfer" full and complete ownership of the farm
subject to his (carlins) right of residency."
the agreement signed by both also contained an "integration clause" that stated "there are no conditions, representatitions, warranties or
agreements not stated in this instrument. six months later the farmhouse burned down and was inhabitable. donald collected the insurance money
but did not use it to repair the home. carlin sues for breach of contract.
will any of their discussions/negotiations be admitted into evidence? Why? or Why not? Discuss.
