That may be the reasoning provided by it, but the fact is that all pokemon go services are currently illegal. Just like downloading music is illegal because "it gravely hurts the artists who have worked hard to produce music for consumers to enjoy"
It doesn't matter the reasoning, just the fact that it's not allowed
