Bots that stay in a reasonable xp per hour have a better chance. Keep all things within reason.

Neither are all the people at lvl 37-38 right now.
I'm also at 38.5 on one of my accounts that consistently gets 200-300k ish 24/7 and it has not even been touched. Lol..
Niantics doesn't have a flagging system, they're too busy talking about how they'll sue pokevision and radar makers.
Also, 33 working at the hospital with only 3 pokestops isn't feasible unless you bot ~ from another botter.
