This is not the case anymore. Obsidian items are Bind on Equip. There are some other items which are also bound.

D2 was barely pay to win. You just had to hit the breakpoints.
You could beat anyone in a duel without even taking damage.

Archeage, if you're outgeared, they can just sit there, let you blow your cooldowns, then just turn around and kill you effortlessly.

im in shitty magnificent gear, and i Wreck people all day in gear thats worth 40x more money
