If the seller does not explicitly state a bin, then he can reject offers, wait on higher offers, or just about do whatever he wants.

"Bin" stands for "Buy it now". As the buyer, you have no option to force the seller into that contract unless if the buyer has explicitly stated that is being offered as an option.
