Legally speaking - no, it's an "unauthorized third party program" and a violation of the EULA/ToS.

In reality however it's quite unlikely that you'll get banned for using SB. It's a kind of "grey area". Blizzard seems to quietly tolerate using it (for example: there're unclosed topics about using SB in battle.net forums). And there is no reliable information that anyone has ever been banned just for using SB.
