Canadian Law, there must be some great cases out there.

there was this one case where a guy broke into this house while the owners were on vacation
he went in through the garage, and as he was trying to break into the living room, he slipped on something and broke his leg
so he was lying in their garage for like 2 days until they came home
then he sued them for i dont even know what the fuck for but he won

i assumed this case was in the US when i read about it.
but lawsuits / civil cases im not so interested in.

however, if he was black, the house clearly* committed a criminal hate crime against him.

Actus reus and Mens rea are common law applications derived from English law. American and Canadian both use Mens rea and Actus reas. Actus reas being a the "bad act" element of an offense.

y u dodge house vs black guy? was it not a hate crime? the house clearly profiled him, criminally or racially.

He would have sued on a negligence claim stating that homeowners owe a duty to Licensees and Trespassers alike that whatever substance was on the ground in the garage that caused him to slip should not have been there. It is foreseeable that if you leave a substance on the ground someone could slip and fall and subsequently injure themselves that. Race is immaterial.

That is probably the analysis that went through the court.

There was no argument, there was a pointless brief mention of 2 words relating to another word, where we didn't agree on its conjured definition to a degree.
