You can pay fines and avoid it if your sentence is under 2 years and you meet 2 conditions:
-You have a clean record
-The judge doesn't consider that setting you free could put others in danger, or there is a very high chance that it would cause some sort of harm
Since Messi meets both of those conditions, he will avoid jail time.
